A motion filed yesterday by Mike Davis' attorney, Terry K. Sherman indicates that Davis intends to change his plea to guilty for all charges filed against him at the trial date scheduled for January 30th and requested that in exchange, he be considered for placement in the CBCF River City Intense Therapy Program.
The motion outlines that Davis had never had previous criminal contact with law enforcement and claims that the charges stem from images he downloaded for his own use and that he never touched a child nor shared the images with anyone else.
The motion goes on to state Davis has suffered "for many years with numerous mental health issues, including severe depression and anxiety, resulting in his attempted use of pornography to self medicate."
Davis has allegedly been receiving counseling since his arrest in September.
Franklin County Prosecutor Ron O’Brien has stated that they did not offer a plea deal to Davis, and contends that prosecution intends to advocate for jail time.
Davis is charged with three counts of pandering sexually oriented matter involving a minor, felonies in the second degree, and one count of possession of sexually oriented matter involving a minor, a felony in the fourth degree. If convicted on all charges, he could face 25 years in prison.
