On Thuesday, September 26th, the second day of his trial, Galen Hurt, 76, accepted a plea offer and entered a plea of guilty to charges that he attempted to rape a four year old girl and a related aggravated child endangerment charge.
“It is a requirement that a child testify under current case law. In 2004, the U.S. Supreme Court said in Crawford v. Washington that the every person accused has a right to confront their accuser, this would apply to children as well,” Leavenworth County Attorney Todd Thompson said.
The plea, which Thompson said was offered in consideration of the victim, means that the now six year old girl will not be required to take the stand.
Hurt was originally charged in 2018 after the girl reported that he had touched her inappropriately while she was at his house.
Hurt will return to court at a later date for his sentencing hearing.
