24-year-old Santos Guerrero Rodriguez was scheduled to appear in court this morning to answer to a charge of murder.
Court records show that he was charged this morning with murder and an additional charge of assault on a child causing death. His next court date is not indicated.
Saturday officers with the San Bernardino Police Department were called to a local hospital to investigate what medical staff had reported to them as a "suspicious death of a male toddler."
When officers arrived, they met with Rodriguez who reportedly initially told them the same story that he had told the medical personnel- that his girlfriend's child "had fallen off a razor scooter and struck his head on the pavement."
In a press release posted to the department's Facebook page, they "conducted an extensive investigation where Rodriguez eventually admitted to losing his temper and reportedly stomping the child's head into the ground."
On Sunday morning Rodriguez was booked into the San Bernardino County West Valley Detention Center on a charge of murder.
The child has been identified by his mother as 3-year-old Michael Anthony Santos in a GoFundMe account she established in his memory.
