Fayetteville, North Carolina: 26-year-old Eduardo G. Rubio remains behind bars at the Cumberland County Jail on charges related to the sexual assault and attempted murder of his girlfriend's 13-year-old daughter.
The girl told investigators that she had gotten into an argument with Rubio on Friday, November 12 and that he had then choked her to the point that she lost consciousness three times. After the third time, she alleged that he had attempted to run her over with his vehicle.
She was treated at the Cape Fear Valley Medical Center for visible bruising to her neck, face, shoulders, arms and knees. During that evaluation it was confirmed that she was approximately four-and-a-half months pregnant.
She stated that she knew she was pregnant, as did Rubio, as he had falsified a pregnancy test at a recent medical check up with his own urine.
The girl stated that he had begun sexually assaulting her approximately two years ago, beginning when she was just 11 years old.
The girl's mother, Rubio's girlfriend of four years, is reportedly also pregnant and claimed to have no knowledge that he was sexually assaulting her daughter.
Rubio has been charged with attempted first-degree murder, attempted murder of an unborn child, first-degree kidnapping, three counts of assault by strangulation, and statutory rape of a child under the age of fifteen.
