Just past midnight on August 24 Harris County deputies responded to a call of an unresponsive baby.
9-month-old Savayah Mason was treated by emergency medical personnel and transported to a nearby hospital. She was pronounced dead at the hospital.
“An autopsy conducted at the Harris County Institute of Forensics indicated the child had been sexually assaulted and died due to asphyxiation during the assault,” deputies wrote in a statement issued through NIXLE Monday.
Investigators interviewed the girl's father, 23-year-old Luis Luna "and determined he was responsible for the child's death."
On Monday, Luna was taken into custody without incident. He is being held at the Harris County Jail on a charge of capitol murder.
He has a court appearance scheduled for September 2.
